HE WAS GONNA COME THIS MONTH, BUT THERE WAS A LITTLE MISUNDERSTANDING ABOUT WHAT THE LAST MONTH WAS FOR HIM, SO I HOPE HE'S WATCHING SO HE CAN HEAR US THANKING HIM. IT WAS WONDERFUL TO HAVE HIM. I'M SURE HE IS HERE. YEAH. . UM, AND SO WE, WE THANK HIM FOR HIS SERVICE AND OH, SORRY, . OKAY. SO WITH THAT, UM, WE'RE GONNA MOVE ON [II. APPROVAL OF MINUTES] TO THE APPROVAL OF MINUTES AND, UH, THIS TIME WE'VE HAD A ROLLING LIST AND WE CAN APPROVE SOME MORE OF THE PENDING MINUTES THIS EVENING. SO I'M GONNA FIRST, UM, PUT UP, UH, DECEMBER 19TH, 2024. WOW. THAT WAS A LONG TIME AGO. . I WAS THERE ALONG WITH PATRICK, DAVID, AND TOM. SO, UM, DO WE HAVE A MOTION? DO I HAVE A MOTION TO APPROVE THOSE MINUTES? I MOVED. SECOND . ALL IN FAVOR? LET'S DO IT. AYE. AYE. LET'S GRAB THIS OPPORTUNITY. IT'S TAKEN ALMOST A YEAR. OKAY. ALL RIGHT. SO THAT PASSED. UM, ALRIGHT. TO THAT PASSED. SO NEXT ONE IS APRIL 10TH, 2025. UH, I WAS NOT THERE, BUT RICHARD, PATRICK, DAVID, AND TOM WERE ALL THERE. DO I HAVE A MOTION TO APPROVE THE MINUTES FROM APRIL 10TH? SO MOVED. OKAY. SECOND. SECOND, RICHARD. OKAY. ALL IN FAVOR? AYE. AYE. LOOKS LIKE IT PASSED UNANIMOUSLY. THANK YOU. UM, NEXT UP WE HAVE OCTOBER 16TH, 2025. AND I WAS THERE ALONG WITH RICHARD ANJALI PATRICK, SEPTEMBER 18TH. DID YOU MISS? CAN'T DO SEPTEMBER. CAN'T DO SEPTEMBER. SEPTEMBER 18TH. SEPTEMBER 18TH. CAN'T DO SEPTEMBER. OH, WE CAN'T DO SEPTEMBER. THEY DON'T HAVE THE RIGHT PEOPLE TO DO SEPTEMBER. YES, THIS WAS MY LIST IS CORRECT. THANK YOU, . THAT'S OKAY. I WAS JUST GOING OFF THE AGENDA. I'M SORRY. OKAY. YEAH. , UH, THIS WAS REVIEWED. THANK YOU. UM, OKAY, SO BACK TO, UH, OCTOBER 16TH, 2025. I WAS THERE ALONG WITH RICHARD, ANJALI, PATRICK, DAVID, AND DANIEL. DO I HAVE A MOTION TO APPROVE? OCTOBER 16TH. SO MOVED. SURE. SECOND ANGEL. ALL IN FAVOR? AYE. AYE. OKAY. THAT PASSED SOME GOOD. WE DID, WE DID. WE'LL GET BACK TO SEPTEMBER . HOPEFULLY WE'LL TAKE A YEAR. . OKAY. UM, SO THAT JUST LEAVES US WITH SEPTEMBER NOT APPROVED. UM, SO WE [III. OLD PUBLIC HEARINGS] HAVE THIS EVENING, WE HAVE SIX OLD PUBLIC HEARINGS ON THE AGENDA. UM, AND I'M ACTUALLY GONNA TAKE THINGS SLIGHTLY OUT OF ORDER BECAUSE WE HAVE A, UM, OUR LAST AGENDA ITEM. UH, WE DON'T WANT THAT APPLICANT TO HAVE TO, UM, SIT THROUGH ALL THE OTHER, UM, APPLICATIONS. SO WE'RE GONNA TAKE THAT OUT OF ORDER. UM, AND THAT IS THE NEW ACCESSORY DWELLING UNIT APPROVAL OF THE APPLICATION OF NICOLETTA BARINI TO CREATE A NEW ACCESSORY DWELLING, UM, UNIT AS PER SECTION 2 95 DASH 67 D 0.2 B IN THE BASEMENT OF A SINGLE FAMILY RESIDENCE AT ONE 10 HIGH STREET. AND SAID PROPERTY IS LOCATED IN THE R 10 ZONING DISTRICT AND IS KNOWN AS SBL 4.1 10 DASH 1 0 8 DASH 60 ON THE TOWN OF BERG'S TAX MAPS, UM, WAIVERS REQUIRED FOR OFF STREET PARKING AND MAXIMUM SQUARE FOOTAGE. UM, SO WITH THAT, WE'RE GONNA JUST ONE MOMENT. UM, SO THIS MATTER WAS BEFORE US, UM, LAST MONTH, AND WE HAD ASKED THE APPLICANT TO PROVIDE DETAIL ON THE ACCESS TO THE REAR OF THE HOUSE AND THE A DU, WHICH WE HAVE NOW RECEIVED. SO WOULD THE APPLICANT LIKE TO SUMMARIZE WHAT WAS SUBMITTED? APPLICANT IS HERE. WOULD YOU LIKE? YEAH, I'M SORRY. SAY ANYTHING ABOUT THE CHANGE THAT WAS THE, THE UPDATE THAT WAS PRESENTED SINCE THE LAST A TO YOU AND YES. OH, WE BUMPED TO THE PHONE. YEAH, WE BUMPED, WE BUMPED INTO, IF YOU DON'T WANT, IF YOU WANT, IF YOU WANNA GO SEVEN, I PUT IT IN THE WRONG PLACE. NOT REALLY PLANNING OR UNLESS I [00:05:01] GET EGG ON MY FACE, SO I FEEL LIKE I A ARRIVED. WE TRY TO BE NICE TO YOU, MITCH. YEAH, YOU, UM, VERY BRIEFLY, OF COURSE. I WAS NOT HERE AT THAT LAST MONTH'S PLANNING BOARD. UM, AND AS I WROTE IN THE COVER LETTER, I UNDERSTAND THAT THERE WAS SOME QUESTION ABOUT ACCESSING THE BACK OF THE PROJECT. AND SO I DID, UM, DOCUMENT WHAT'S EXISTING AT THE HOUSE AND UM, AND I'M GOING TO NOW PLUG IN MY DEVICE. YOU CAN SEE MY SCREEN SAVER. I KNOW. THIS IS VERY EXCITING. , YOU WEREN'T EXPECTING THAT. SO , I'M GIVING YOU A MINUTE TO CATCH UP. THIS IS, OH, THERE YOU GO. OKAY. SO, UM, , LET'S SEE IF WE CAN DO THIS HERE. PEOPLE, I LIKE THAT BACKGROUND. YEAH, PRETTY MUCH. ALRIGHT, IT'S COMING. SORRY GUYS. UM, IN BRIEF, UM, I CAN PUT A, SORRY. HERE WE GO. UM, AS YOU KNOW, THE HOUSE OCCUPIES THE VERY FRONT OF A VERY DEEP LOT AND, UM, AND I TRANSPOSED THE CONTRA LINES THAT YOU CAN GET ON THE WESTCHESTER COUNTY, UH, UH, WEBSITE, UH, FOR THE TAX LOTS. UM, SO THEY'RE, THEY SEEM TO BE FAIRLY, UH, ACCURATE. YOU CAN SEE THAT THERE'S A FALL OFF AND IN FACT THE PROPOSED SITE FOR THE A DU IS IN THE BACK AND IT'S DOWN, UH, FULL FLIGHT OF STAIRS. AND IN FACT, UM, I'M GONNA ZOOM US UP HERE. WELL, LET ME JUST WALK YOU DOWN THE BACK. AS YOU GO AROUND THE GARAGE, THERE'S A PATH THAT'S A PAVED AND THERE ARE STAIRS DOWN, UM, UNDERNEATH AN ARBOR, REALLY, UM, OF WISTERIA, WHICH IS QUITE CHARMING. AND I WOULD SAY THAT THE ONLY THING IN MY OPINION THAT IT LACKS IS A, AN IMPROVEMENT ON THE HANDRAIL. YOU CAN SEE IT HERE ON THE LEFT. IT'S SORT OF COMPRISED OF TWO, TWO BARS, UH, ON POSTS. AND SO IF THE BOARD FEELS THAT'S A REQUIREMENT, WE'LL CERTAINLY DO IT. I THINK IT WOULD HELP. AND I DON'T THINK IT WOULD COST AN ARM AND A LEG. UH, BUT THERE ARE NO GUARDRAILS REQUIRED BECAUSE IT'S ALL FOLLOWS THE GRADE, SO THERE'S NO WAY TO FALL OFF OF IT ONTO ANYTHING. UM, WHEN YOU HIT THE BOTTOM, UH, ESSENTIALLY YOU'RE ON, UH, PAY CONCRETE PAVERS. UM, AND IT'S, I THINK IT SATISFIES THE REQUIREMENTS AND THE NEEDS OF SOMEBODY LIVING DOWNSTAIRS TO BE ABLE TO HAVE A PATH THAT CAN BE SHOVELED CLEAN IN THE WINTER THAT'S WELL-LIGHTED THAT, UM, THAT IS ALREADY THERE. UM, AND THE GOAL, I THINK OF THE A DU PROJECT IS TO MAKE IT AFFORDABLE. AND, UM, WE ARE GETTING SOME FUNDING FROM FAMILY TO FAMILY, WHICH IS AMAZING. UH, FAMILY TO FAMILY, I'M SORRY, HABITAT FOR HUMANITY. MAYBE WE'LL GET SOMETHING NOW THAT I PUT A PLUG FOR THEM. FAMILY TO FAMILY, A WONDERFUL ORGANIZATION HERE AND VERY GENEROUS. UM, IN ANY EVENT, UM, UM, THAT MONEY'S GONNA BE SENT ON THE INTERIOR, REALLY, UM, ALMOST NO WORK HAS TO HAPPEN ON THE OUTSIDE EXCEPT FOR CREATING ONE EGRESS WINDOW, BEING THAT THAT IS GONNA BE A PRIMARY EGRESS FOR THE A DU. IT'S GONNA HAVE TO BE BROUGHT UP TO CODE DURING BUILDING PERMIT PROCESS. OKAY. SO THAT, THAT, THAT EGRESS WILL HAVE AN ACTUAL A, A CODE COMPLIANT THE WINDOW OUT OF THE, IT'S A SLEEPING ROOM, SO IT'S REALLY A SMALL WINDOW AND WE'RE GONNA ENLARGE IT. OKAY. AND, UM, BUT THERE'S A WALKOUT, YOU KNOW, WE'RE ACTUALLY, THERE'S CURRENTLY A SLIDING PATIO DOOR, BUT THERE'S A, WE'RE CHANGING IT FOR A SWINGING DOOR. UM, AND I THINK IT SHOULD BE LOVELY SO I CAN SHOW PLANS IF IT, YOU HAVEN'T SEEN THEM ALREADY, BUT I'M HAPPY TO JUST SHUT UP . NO, NO, THAT WAS SUPER HELPFUL. UM, I WANNA SEE, UM, IF ANY OF MY FELLOW PLANNING BOARD MEMBERS HAVE [00:10:01] QUESTIONS OR COMMENTS ABOUT THIS ADDITIONAL INFORMATION. NOTHING HERE. NO. THANKS FOR ADDRESSING OUR COMMENTS. YEAH, YEAH, VERY HELPFUL. UM, WOULD ANY MEMBERS OF THE PUBLIC LIKE TO SPEAK ON THIS MATTER? NO. OKAY. WELL, UM, WE'RE, WE, I THINK WE SAID LAST TIME, WE'RE SUPPORTIVE OF THIS. I'M ACTUALLY EXCITED TO HEAR THAT THIS IS ONE OF THE HABITAT FUNDED PROJECTS, SO THAT'S GREAT. UM, SO WITH THAT, DO I HAVE A MOTION TO APPROVE THE APPLICATION FOR AN A DU AT ONE 10 HIGH STREET WITH WAIVERS FOR PARKING AND MAXIMUM SQUARE FOOTAGE? SO MOVED. SECOND. SECOND. OKAY. ALL IN FAVOR? AYE. AYE. YOU PASSED. CONGRATULATIONS. THANK YOU FOR TAKING US FIRST. YES, YOU'RE WELCOME. OKAY. ALRIGHT, SO NOW WE'RE GONNA GO BACK IN ORDER. UM, WE HAVE A FINAL SUBDIVISION APPROVAL FOR THE APPLICATION OF CASSANDRA SUITE AND LIBOR ET ET IC FOR THE CREATION OF A NEW BUILDING LOT LOCATED AT 16. SHELDON PLACE SAID PROPERTIES LOCATED IN THE R 10 ZONING DISTRICT AND IS KNOWN AS SBL 4.20 DASH 18 DASH FOUR ON THE TOWN OF GREENBURG TAX MAPS. UM, YOU ALL MAY RECALL THAT WE PREVIOUSLY APPROVED PRELIMINARY SUBDIVISION APPROVAL FOR THIS MATTER, AND, UM, THEY HAVE, THE APPLICANT HAS NOW REVISED THE PLAT AS REQUESTED BY OUR CONSULTANTS AND OBTAINED HEALTH DEPARTMENT APPROVAL, AND THEREFORE WE CAN NOW GRANT FINAL SUBDIVISION APPROVAL. UM, DOES ANY MEMBER OF THE BOARD HAVE ANY QUESTIONS? I HAVE BEEN RECUSING MYSELF, SO, OH, I'M JUST GONNA GO SIT. OKAY. ALL RIGHT. LET'S BE CONSISTENT. ALL RIGHT. THANK YOU ANGEL. UM, ANYONE QUESTIONS ABOUT THE NO, NO QUESTIONS? NO. OKAY. UM, WOULD ANY MEMBERS OF THE PUBLIC LIKE TO SPEAK ON THIS MATTER OR THE APPLICANT? , ? DO I HAVE ANYONE IN THE PUBLIC? UM, AND ACTUALLY, UM, PATRICK, DO YOU HAVE ANYTHING TO ADD OR ANYTHING YOU WANNA SAY? OUR VILLAGE PLANNER? NO, NOT AT ALL. OKAY. THEY'VE DONE WHAT WE'VE ASKED THEM TO DO ON THOSE REVISIONS. MM-HMM . OKAY. UM, SO WITH THAT, DO I HAVE A MOTION TO GRANT, FINAL SUBDIVISION APPROVAL FOR THE PROPERTY AT 16 SHELDON PLACE CONDITIONED ON UPON PAYMENT OF THE RECREATION FEE IN THE AMOUNT OF $10,000 AND SUCH OTHER TYPICAL CONDITIONS OF FINAL SUBDIVISION APPROVAL. SO MOVED. SO MOVED. SECOND, PATRICK. SECOND. IT. UM, ALL IN FAVOR? AYE. AYE. OKAY. SO IT PASSED. CONGRATULATIONS, . THANK YOU. ALL RIGHT. SO TO CLEAR PROCEDURE, YOU HAVE TO COME UP TO THE MIC AND SAY WHO YOU ARE. . SORRY. I'M CASSANDRA. THANK YOU ALL SO MUCH. IT'S BEEN A YEAR AND A HALF. AND I SAY YOUR ADDRESS, . OH. UM, A WHAT? JUST SAY FOR THE RECORD. JUST SAY THE, OH, FOR THE RECORD. MY NAME IS CASSANDRA. SWEET. UM, I'M VERY GRATEFUL FOR THE WORK OF THE BOARD AND THE VILLAGE AND THIS WHOLE PROCESS. UM, JUST FOR CLARIFICATION, UM, THE NEXT STEP IS, UM, OBVIOUSLY I BRING THE CHECK AND THEN I PICK UP THAT FINAL PLAT SIGNED BY YOU GUYS TONIGHT. I SUPPOSE YOU HAVE IT. UM, YOU'RE LOOKING SHE'LL MAYBE OUR, WELL, YOU'LL HAVE TO PAY THE REC FEE FIRST AND THEN WE'LL HAVE MADAM CHAIR SIGN IT AND THEN YOU HAVE TO GET, BRING IT TO, TO HAVE THE TAX ASSESSOR SIGN IT AND THEN YOU CAN BRING IT TO THE COUNTY TAXES. GREAT. WONDERFUL. SHE TAXES YOU DO THAT? NO. IF SURE. WHY NOT? HAND CHECK. YEAH, I CAN. THAT WOULD LEAD UP TO THE POWERS THAT BIG NOT, I MEAN, JUST SO IT'S EASIER FOR EVA TO, OR FROM WHOEVER SIGN IT AT THE END OF THE NIGHT. SHE PAID IF I LEAVE A CHECK WITH HER. OKAY. IF YOU LEAVE, IF YOU COULD, YOU WANNA LEAVE A CHECK? I COULD LEAVE WITH HER AND THEN YOU SIGN. JUST 'CAUSE IT'S BEEN A LOT OF RUNNING AROUND. UNDERSTOOD. THAT'S FINE. IS ONE LAST TASK. I DON'T THINK THERE'S ANY OTHER, YOU, YOU COULD SIGN IT EVEN BUDDY, HOLD ONTO IT. JUST, JUST TO GIVE US A CHANCE TO CHECK THE STANDARD CONDITIONS. YEAH, BUT I DON'T THINK THERE'S ANYTHING UNUSUAL ON THIS CHECK. GOTTA CLEAR. OKAY. HECK YEAH, THE CHECK HAS TO CLEAR, WHICH, YOU KNOW, IT'S BEEN A MONTH FIGURING THAT ONE OUT, BUT I'M THERE. THE CHECK WITH MARY ELLEN. I'LL HAVE, I'LL HAVE THE MADAM CHAIR SIGN IT AFTER THE MEETING AND THEN I'LL HAVE MY STATEMENT. PERFECT. WE'LL HAVE OUR, OUR TEAM GO OVER IT. OKAY. YEAH. EXCELLENT. I MEAN, WE CAN HAVE, EVA CAN SIGN IT LATER. I KNOW YOU TOOK IT BACK DOWNSTAIRS. YEAH, SHE CAN SIGN IT LATER. YOU CAN JUST HOLD ON EVEN IF YOU WANNA BRING THE CHECK IN TOMORROW. OKAY. WE'LL DO THAT. I'LL COME IN TOMORROW MORNING. OKAY. SO SHE'S NOT GONNA BE RELEASED UNTIL, YEAH. GOOD. YOU HAVE TO SIGN THE, UH, OH AND I FINE. THANK YOU GUYS. YES, ALL FOR THAT. GOOD, GOOD, GOOD. YOU'RE WELCOME. GET THAT PART OF IT. CLEARED. YEAH, UP. OKAY. EXCELLENT. ALL THANK YOU. ALL RIGHT. SO WHILE SHE'S SIGNING THAT, I WILL GO ON, UM, TO OUR NEXT AGENDA ITEM, WHICH IS A REQUEST FOR AN EXTENSION OF APPROVAL FOR SITE PLAN APPROVAL FOR [00:15:01] THE DEMOLITION OF AN EXISTING, UH, THREE FAMILY BUILDING AT FOUR EXISTING TAX LOTS, LOCATED AT 4 25 WARBURTON AVENUE AND ZERO RIDGE STREET. SAID PROPERTY IS IN THE MR ZERO, UH, SLASH TWO R DASH 3.5 ZONING DISTRICTS AND IS KNOWN AS SBL 4.70 DASH 52 DASH 7 10 11, AND 41 ON THE VILLAGE TAX MAPS. UM, SO THE BOARD WILL REMEMBER THAT ABOUT A YEAR AGO WE GRANTED SITE PLAN PLAN APPROVAL ONLY FOR THE DEMOLITION OF THE EXISTING BUILDING AT 4 25 WARBURG. WHILE, UM, THEY HAVE BEEN WORKING TOWARDS SATISFYING THE CONDITIONS FOR THE ISSUANCE OF A DEMOLITION PERMIT, THEY HAVE NOT YET OBTAINED THE DEMOLITION PERMIT AND THEREFORE REQUIRE AN EXTENSION OF THE SITE PLAN APPROVAL. AND WOULD THE APPLICANT LIKE TO SAY ANYTHING TO, UM, I WANNA SAY AS LITTLE AS POSSIBLE, PATTY STEINER, GOTHAM DESIGN, UH, REPRESENTING THE OWNERS OF THE PROPERTY, THE APPLICANT? UM, WHAT YOU JUST SAID IS EXACTLY RIGHT. WE'RE GOING THROUGH ALL THE DIFFERENT STEPS. WE KNOW THIS IS A SENSITIVE PROPERTY IN A TIGHT NEIGHBORHOOD THAT NEEDS TO BE DONE JUST RIGHT. SO WE'RE TRYING TO MAKE IT PERFECT. THANK YOU. UM, SO AS A REQUEST, UM, FOR AN EXTENSION, THIS IS NOT ACTUALLY A PUBLIC HEARING. UM, AND I JUST WANT TO SEE IF ANY OF OUR BOARD MEMBERS HAVE ANY QUESTIONS OR COMMENTS? NOPE. UM, AND DO I HAVE A MOTION TO GRANT A ONE YEAR EXTENSION FOR THE SITE PLAN APPROVAL FOR THE DEMOLITION OF THE CHAIR? I, I WHY IT'S NOT A PUBLIC MEETING. EXCUSE ME. EXCUSE ME. UM, ALRIGHT, LINDA? YEAH. DO YOU WANNA, SO, UM, EXTENSIONS TECHNICALLY DON'T REQUIRE A PUBLIC HEARING, UM, BECAUSE IT'S JUST AN EXTENSION REQUEST, IT'S NOT AN APPLICATION APPROVAL. THE APPLICATION'S ALREADY BEEN APPROVED MM-HMM . SO THERE'S NO REQUIREMENT UNDER THE LAW TO HAVE A PUBLIC HEARING ON AN EXTENSION. OKAY. WELL, IT IS A PUBLIC MEETING, JUST NOT HEARING. OKAY. AND, AND I WILL ACCEPT A, IF SOMEBODY WANTS TO COME AND SPEAK, UM, WITH ANY COMMENTS THIS EVENING, I WILL INVITE THEM UP TO THE MICROPHONE. THE BOARD DOES HAVE THE DISCRETION TO ALLOW PUBLIC COMMENT, SO I'M WAITING TO SEE IF ANY MEMBER OF THE PUBLIC WOULD LIKE TO SPEAK . PATTY, CAN YOU JUST ITERATE FOR THE RECORD WHO THE OWNER OF THE PROPERTY IS? UH, OMAR AND TARIQ? UM, MAUD, IT'S ACTUALLY, UH, TAREK, UM, REALTY CORPORATION, BUT THEY'RE THE PRINCIPALS. OKAY. OKAY. THANK YOU FOR ALLOWING ME TO SPEAK. UM, WHEN I LAST APPEARED BEFORE THIS BOARD ON THIS PROJECT, UM, IT WAS SUGGESTED BY MR. BASS THAT I RETAIN AN ATTORNEY TO PROTECT MY INTEREST. IF YOU REMEMBER, MY HOUSE LITERALLY TOUCHES THIS PROPERTY. UM, I TOOK SOME UMBRAGE AT THAT, SAID, WHY DO I HAVE TO SPEND MONEY? AND I REALIZED IT'S KIND OF AN INSURANCE POLICY. SO I'VE BEEN IN CONTACT WITH AN ATTORNEY WHO RECOMMENDED THAT I CONTACT A STRUCTURAL ENGINEER TO PROVIDE ME WITH INFORMATION, UM, THAT WOULD ALLOW ME TO PUT INTO THE RECORD PROTECTIONS THAT I BELIEVE NEED TO HAPPEN DURING THE DEMO. SO IF ANYTHING HAPPENS ON MY PROPERTY, UM, UM, I, I HAVE THAT AS PART OF THE PUBLIC RECORD. UM, I JUST WANTED TO LET YOU KNOW THAT I, SINCE THE LAST TIME WE WERE HERE, THE BUILDING DEPARTMENT, AND I'M SURE THAT MR. MOZZI WILL CORRECT ME IF I'M WRONG, UM, ALLOWED THE, UH, REMOVAL OF DEBRIS FROM INSIDE OF THE BUILDING. AND WHEN THAT COMMENCED, THERE WAS A HUGE AMOUNT OF DUST THAT WAS BEING BLOWN UP. WE'RE TALKING ABOUT 110 YEAR OLD BUILDING. UM, I QUESTIONED WHETHER THAT WAS APPROVED AND DEBRIS REMOVAL IS, BUT THEY WERE SUPPOSED TO KEEP THE DUST DOWN. I CAME TO AN AGREEMENT WITH MR. STEIN AND HIS, UH, HIS DEMO, UH, CONTRACTOR. I WAS PROVIDING THEM WITH THE POSSIBILITY TO USE MY WATER AND MY ELECTRIC TO DO THIS CLEANUP. IN THE COURSE OF THAT QUOTE CLEANUP, UM, I EXCHANGED INFORMATION WITH MR. STEIN SCHNEIDER, WHICH I DON'T KNOW IF THIS BOARD'S BEEN PRIVY TO WHO WAS SENT TO THE BUILDING DEPARTMENT WHERE PATTY, IF IT'S, I'M ASSUMING IT'S OKAY IF I CALLING PATTY, UM, SENT ME A 10 PAGE LETTER SAYING, THIS IS WHAT WE'RE GOING TO DO, PROTECT YOUR, YOUR PROPERTY. AND IT WAS, IT WAS A GREAT LETTER. AND I RESPONDED, THERE WERE SOME ADDITIONAL THINGS THAT I THOUGHT NEEDED TO BE ADDRESSED. HE WROTE BACK AND SAID, I AGREE WITH ALL OF THIS, IT'S ALL GOOD. AND THEN I RECEIVED A LETTER OF AGREEMENT, WHICH I WAS SUPPOSED TO SIGN AND HAVE NOTARIZED, AND I HAVE REFUSED TO SIGN THAT BECAUSE THERE ARE ITEMS IN THAT LETTER OF AGREEMENT THAT WOULD LIMIT MY ABILITY TO CHALLENGE PROBLEMS THAT OCCURRED DUE TO THIS DEMOLITION. AND I HAVE SENT LETTERS TO THE BUILDING DEPARTMENT, I BELIEVE I, I COPIED, UH, UH, UH, MURPHY, MS. MURPHY ON THAT. SO I'M TRYING TO GET ALL OF THIS IN PLACE. YEAH. I JUST WANNA, I JUST WANNA POINT OUT, I THINK THESE [00:20:01] MATTERS ARE MORE HAVING TO DO WITH THE BUILDING DEPARTMENT. THESE ARE NOT UNDER OUR PURVIEW. SO IF YOU COULD JUST SUMMARIZE WHAT'S, WHAT'S RELEVANT TO OUR, SO HERE'S, HERE'S MY SUMMARY. I WOULD LIKE TO SEE THIS PROJECT GO FORWARD, BUT I WOULD ALSO LIKE TO MAKE SURE THAT THE APPLICANT IS NOT DOING THINGS THAT THEY'VE ALREADY BEEN DOING THAT ARE NOT ACCORDING TO WHAT WAS, WAS BEING ALLOWED. I'D LIKE THE BOARD TO KNOW THAT THERE ARE ISSUES GOING ON. THEY TOOK OUT AN OIL TANK THE OTHER DAY AND THEY WERE DUMPING THE OIL DEBRIS IN THE FIELD RIGHT NEXT TO THE HOUSE. THAT'S DEFINITELY CONCERN. THAT'S NOT PROVEN ON RO LISTEN, I CAN SHOW YOU WHERE IT IS, BUDDY. OKAY. OKAY. WE'RE ACTUALLY, THIS IS A, THIS IS A BUILDING DEPARTMENT VILLAGE MATTERS. SO THEN WE'LL DISCUSS THAT AND I'LL SHOW YOU WHERE IT HAPPENED IN TWO LOCATIONS. OKAY. BUT I, I DO WANNA, I WANNA RESPECT WHAT MY POINT IS. I'D LIKE, I'D LIKE TO HAVE WRITTEN INTO THE PUBLIC RECORD THAT THE APPLICANT IS ALREADY GOING BEYOND WHAT HAS BEEN ALLOWED. AND I'D LIKE TO MAKE SURE THAT THE VILLAGE IS ON NOTICE TO KEEP A CLOSE EYE ON THIS. SO, YEAH. OKAY. SO I DON'T HAVE A PROBLEM MOVING FORWARD. THANK YOU. OKAY. THANK YOU. THANK YOU. SO, WE'LL, WE'LL, THE VILLAGE HAS THEIR EYE ON THIS, I'M SURE. AND, UM, THANK YOU MR. MENZI. OKAY. UM, ALRIGHT. SO I HAVE ONE QUESTION. UH, IF, IF THERE'S ANOTHER QUESTION FROM THE AUDIENCE, PLEASE, PLEASE, YOU HAVE TO COME UP TO THE MIC. YOU HAVE TO SAY WHO YOU ARE AND YOUR NAME AND ADDRESS PLEASE. UH, JENNY EPAN. I'M ON 15 RIDGE STREET. UH, QUICK QUESTION. THE APPLICATION JUST CHANGED, IT WAS 4 25 WARTON AND NOW IT SAYS 4 25 AND ZERO RIDGE STREET. I SENT A QUERY VIA THE EMAIL. NO CONSTRUCTION'S COMING ON RIDGE STREET. AM I CORRECT? LIKE, IT'S ONLY GONNA STAY ON WARTON. DISAPPROVAL IS ONLY FOR THE DEMOLITION. SO THAT'S ONLY GONNA BE ON, ON WARTON, CORRECT? THAT'S IT. YEAH, THAT'S ALL. OKAY, THANKS. OKAY. UM, SO AT THIS POINT WE ARE SIMPLY ENTERTAINING, UM, TAKING A MOTION ON GRANTING A ONE YEAR EXTENSION FOR THE SITE PLAN APPROVAL, UM, FOR THE DEMOLITION IN THE EXISTING BUILDING AT 4 25 WARTON, SUBJECT TO ALL THE SAME CONDITIONS AS SET FORTH IN THE ORIGINAL APPROVAL. JUST WANNA MAKE SURE, DOES ANYONE HAVE ANY COMMENTS OR QUESTIONS AT THIS POINT BEFORE WE TAKE THE VOTE? NO. OKAY. YES. UM, RICHARD, SO MOVED. SO MOVED. WHO SECONDS IT SECOND. OKAY, PATRICK, ALL IN FAVOR? AYE. AYE. OKAY. UNANIMOUSLY GRANTED AN EXTENSION, UM, OF ONE YEAR, SO THANK YOU. THANK YOU. ALL RIGHT. SO NEXT WE HAVE VIEW PRESERVATION ADVISORY AND SITE PLAN APPROVAL FOR THE APPLICATION OF RT B WASHINGTON, LLC FOR A MIXED USE DEVELOPMENT, CREATING ONE COMMERCIAL SPACE AND 20 RESIDENTIAL UNITS WITH 20 PARKING SPACES AND A PUBLIC ACCESS MUSE ON TWO EXISTING BUILDING LOTS LOCATED AT NINE DASH 17 WASHINGTON AVENUE. SAID, PROPERTY IS IN THE MRC ZONING DISTRICT AND IS KNOWN AS SBL 4.70 DASH 48, DASH 37 AND 38 ON THE TOWN OF GREENBURG TAX MAPS. UM, AS MANY OF YOU KNOW, THIS HAS BEEN ON OUR AGENDA THIS MATTER, UM, SEVERAL TIMES, AND THE APPLICANT HAS SUBMITTED SOME ADDITIONAL MATERIAL. OUR REVIEW AT THIS TIME IS STILL FOCUSED INITIALLY ON VIEW PRESERVATION AND WOULD THE APPLICANT LIKE TO PRESENT THE ADDITIONAL MATERIAL IN SUBMISSION? GOOD EVENING. I'M CHRISTINA GRIFFIN. UM, PRINCIP, CGA STUDIO ARCHITECT. I'M HERE WITH SUZANNE LEVINE, PROJECT ARCHITECT AND OUR TEAM, JACOB AMIR, THE ATTORNEY AND NEIL DELUCA, WHO'S ONE OF THE, UH, OWNERS, DEVELOPERS. UM, WE ARE HERE TO SHOW YOU, UH, SOME OF THE, UH, ITEMS THAT WE WERE ASKED TO, UH, PROVIDE AT THE LAST MEETING. AND THE FIRST ITEM IS THE DETAIL OF THE ENTRY TO THE MUSE. THIS IS A COLORED ELEVATION TO SHOW OUR DESIGN FOR THAT. FOR A GATE, THERE WILL BE A, A FOUR FOOT WIDE SWING GATE. UM, AND THERE'S JUST DECORATIVE PIECES ON EACH SIDE AT EACH ENTRANCE TO THE MUSE. THIS IS THE ONE THAT YOU ENTER OFF OF WASHINGTON, UH, AVENUE. AND THERE'S ONE ON THE OTHER SIDE THAT YOU CAN ENTER ONCE YOU GO UP THE STEPS. UM, FROM THE PARKING LOT, I KNOW IT'S SHOWING THE GATE PICTURE. THIS IS SHOWING THE GATE IN A LITTLE MORE DETAIL. IF YOU LOOK AT THE PLAN, WE HAVE LOCATED THE GATE HERE. WE DID THIS SO THAT YOU COULD LEAVE THE GATE OPEN. THIS IS ALL GONNA BE CONTROLLED ELECTRONICALLY. UM, THE GATE WILL BE OPEN, UH, SIX 30 TO 8:00 PM MONDAY THROUGH FRIDAY. AND THEN, UH, ON THE WEEKENDS FROM EIGHT FIVE, UM, WE'RE [00:25:01] GONNA HAVE, UH, ELECTRONIC CONTROLS THAT THE, UH, RESIDENTS CAN USE. UM, THERE'S GONNA BE EMERGENCY BACKUP EITHER WITH A BATTERY OR, UM, EMERGENCY GENERATOR. UM, IN CASE IT FAILS, UM, THE DOOR IS PUT HERE BECAUSE WE CAN KEEP THE GATE OPEN. WE ALSO WERE, UH, WANTED TO GET ACCESS ALSO WITH A KEY AND, AND DONE ELECTRONICALLY TO THE ELEVATOR IN CASE THE CAFE WILL USE THIS ELEVATOR TO GO DOWN BELOW INTO THE, UH, BASEMENT, UM, WHICH IS LIKE GETTING ACCESS TO VALUABLE STORAGE FOR THIS LITTLE CAFE. THE, UM, OPERATIONAL, UH, PARAMETERS FOR THE, FOR THE GATES IS LISTED HERE. UM, THIS WAS IN THE LETTER THAT WE SENT YOU. SO I'D LIKE TO KNOW, WOULD YOU LIKE ME TO GO THROUGH THIS WITH YOU? UM, UM, I CAN JUST GO THROUGH IT QUICKLY. MM-HMM . UM, SO WE HAVE TWO, UH, SECU ENTRY GATES. UM, BOTH WILL AUTOMATICALLY UNLOCK DURING PUBLIC ACCESS HOURS. PROGRAMMABLE REMOTE GATE OPENER WILL FACILITATE THE OPENING AND CLOSING OF THE GATES AT DESIGNATED TIMES. BOTH GATES WILL HAVE FIVE, FOUR FOOT WIDE OPENINGS. UH, THERE'LL BE SIGNAGE NEXT TO EACH GATE THAT WILL INDICATE THE HOURS. OPERATION GATES WILL ALWAYS BE UNLOCKED WHEN THE MUSE, UH, FROM THE MUSE SITE TO ALLOW RESIDENTS TO EXIT FREELY AND TO MAKE SURE A PEDESTRIAN, UM, THAT IS THERE AT CLOSING CAN, CAN, CAN LEAVE THE MUSE. UM, THESE GATE OPERATORS WILL BE TIED TO A FIRE ALARM SYSTEM. UM, IN THE EVENT OF AN EMERGENCY, THE GATES WILL AUTOMATICALLY UNLOCK. UM, I MENTIONED, UH, IN CASE WE HAVE A POWER FAILURE, WE'RE GONNA HAVE SOME BATTERY BACKUP OR EMERGENCY GENERATOR, UM, TO, UM, KICK IN WHEN THAT HAPPENS. AND WE'RE ALSO GONNA HAVE TWO NOX BOXES. THESE ARE, UH, EMERGENCY USE TYPE BOXES THAT IS ACCESSIBLE TO, UH, THE FIRE DEPARTMENT AND THE POLICE DEPARTMENT. SO THEY CAN GET IN THAT BOX AND GET THE KEYS AND OPEN THE GATES. AND THERE'S GONNA BE ONE, UM, ON NEXT TO EACH GATE TO THE MUSE. CHRISTINA, BEFORE YOU GO, CAN YOU GO BACK TO THE PREVIOUS SLIDE SHOWING THE F THE FACADE? UH, WOULD, IF I'M STANDING ACROSS THE STREET WITH THIS FACADE, WOULD I SEE THE BULKHEAD? IS THAT EXCLUDED FROM THIS, UH, ELEVATION? IT'S ON THE ELEVATION. OH, HOLD ON, SUZANNE. WELL, SORRY. HI. YOU KNOW IT, YOU WOULD SEE THE BULKHEAD AND IT IS FOR THE RECORD, PLEASE. SUZANNE LEVINE, UM, PROJECT ARCHITECT. UH, I THINK IT'S VERY FADED ON THIS SCREEN THAT YOU'RE LOOKING AT. IT'S, I THINK YOU CAN SEE IT IF YOU LOOK ON THE LAPTOP, UNFORTUNATELY, IT'S JUST A, IT'S A, IT'S A FADED LAYER BECAUSE IT'S, IT'S, IT'S, YOU KNOW, RECESSED. IT'S JUST A, IT'S JUST A, IT MADE IT WIPE. WE, WE CAN SHOW YOU THE LAPTOP IF YOU LIKE. WE DIDN'T INTEND TO TAKE IT OFF. WE CAN SHOW YOU THE ELEVATION THAT HAS IT ON IT, ON THE, WE HAVE THOSE DRAWINGS WITH US. I, I JUST CAN'T SEE IT. YEAH, BUT IT, IT'S THERE AND IT, UH, WE WERE FOCUSED ON THE ENTRY. I UNDERSTAND THAT. BUT YEAH, WHEN I WOULD EXPECT ALL THE FACADE, YOU KNOW, ELEMENTS WOULD BE SHOWN AND NOT BE THAT FAINT. IT'S ON THE DRILL. WE CAN BRING THE LAPTOP UP FOR YOU IF YOU LIKE. WOULD YOU LIKE ME TO BRING IT UP PLEASE? DO YOU SEE IT? MAYBE GLASSES? WELL, YOU CAN SEE IT ON YOURS. I DIDN'T ASK IT UNTIL WHERE, WHERE IS IT? RIGHT WHERE THE MOUSE IS? IT'S WHITE. YEAH. IT'S KIND OF VERY FAINT. YEAH, WE WILL, WE WILL GET THAT TO YOU. THERE'S, WE'RE HAVING A LITTLE GLITCH HERE. SORRY ABOUT THAT. MY SUGGESTION IS DON'T LEAVE IT OFF, IS TO HIGHLIGHT THAT A LITTLE BIT MORE IN THE NEXT ITERATION. NO PROBLEM. WE, UH, WASN'T INTENTIONAL. UM, SO THIS IS, UH, THE SLIDE JUST SHOWING THE DETAILS OF THE GATE, THE DESIGN THAT WE CAME UP WITH. UM, YOU'LL SEE THAT AFTER YOU GO DOWN THIS, UM, PATH AND THEN TURN LEFT. UM, WE WERE ALSO ASKED TO GIVE DETAILS OF THE ROOF DECKS. UM, WE HAVE, UH, OUTDOOR FURNITURE NOW SHOWN ON THE DECKS TO, SO THAT YOU CAN SEE HOW YOU COULD HAVE A SITTING AREA AND DINING AREA FOR EACH UNIT. UM, WE HAVE, UM, THE, UH, SECTIONS THROUGH THE BULKHEAD AND THE HEIGHT OF THE RAILING. [00:30:01] UM, WE EVEN HAVE OUR, UM, LIGHTING, UH, OPTIONS FOR SCONCES AND, UH, RECESS STEP LIGHTS. UM, WE HAVE, UH, IMAGES OF OTHER ROOF DECKS. UH, THIS IS, THESE ARE THE ROOF DECKS WE DESIGNED AT, UH, 400 WAR BURDEN. JUST TO GIVE YOU AN IDEA OF WHAT THEY WOULD LOOK LIKE. ONCE THERE'S FURNITURE ON TOP, THERE'S GOING TO BE A LIMIT OF, UH, FIVE FEET IN HEIGHT FOR ANYTHING THAT'S ON THESE DECKS. THE, UM, UMBRELLAS WILL BE PUT INTO BASES THAT ARE 155 POUNDS AND THE UMBRELLAS WILL, WILL, THERE WILL BE REGULATIONS FOR THE HOMEOWNER ASSOCIATION. SO THEY WERE, THE UMBRELLAS WILL BE TAKEN DOWN IF THERE ARE WINDS OVER 20 MILES PER HOUR. UM, SO THESE ARE JUST DIFFERENT VIEWS OF THE KIND OF, UM, OF, OF DIFFERENT ROOF DECKS THAT, UM, GIVES YOU AN IDEA OF WHAT, WHAT THESE WOULD LOOK LIKE IF YOU'RE LOOKING DOWN. WE WERE ALSO ASKED TO PROVIDE INFORMATION ABOUT THE RELATIONSHIP OF THE, UM, THE BUILDINGS, UH, JUST TO THE EAST OF THIS PROPERTY. SO, UM, WE HAVE A, UH, RED LINE INDICATING THE GRADES. THIS IS, UM, THE HEIGHTS OF THE, AND THE HEIGHT OF THE RETAINING WALL NEXT DOOR. THE HEIGHT WAS MEASURED BY OUR SURVEYOR, AND WE HAVE A STEPPED RETAINING WALL. AND YOU CAN SEE FROM THIS PICTURE ON THE LEFT THAT, UM, THIS IS THE RETAINING WALL. IT VARIES IN HEIGHT. AND, UH, THE FIRST BUILDING HERE, WHICH IS 5 83, 5 85 WAR BURDEN, UH, IS THIS, UM, IS THIS BUILDING HERE IN THIS PHOTO? UH, THE, THE GRADE HERE IS SLOPING. THERE'S A DRIVEWAY THAT COMES UP HERE AND THE, AND THE STEPPED RETAINING WALL NEXT TO IT. THIS IS DEPICTED, UH, DOWN BELOW ON OUR ELEVATIONS BY THIS RED LINE. AND FROM THE, UM, GRADE OF THE WALK LEADING TO THE MUSE, THIS ROUTINE WALL GOES FROM 2.9 FEET ABOVE GRADE, UP TO ABOUT SEVEN FEET, THEN UP TO 11 FEET, AND THEN UP TO, AT THE HIGHEST POINT 17 FEET. SO THE, THIS BUILDING, UH, 4 83 4 85 IS EXTENDS FROM THIS END TO, FROM THE 2.9 FOOT RETAINING WALL ALL THE WAY TO THIS END. THAT RISES UP TO, UM, ABOUT 11, 11 FEET ABOVE THE MUSE. AND THEN THE NEXT BUILDING, WHICH IS IN THIS PHOTOGRAPH, IS THIS ONE HERE IT IS 4 87 WAR BURDEN THAT IS GOING TO BE OVER HERE, WHICH IS, UM, HAS, UH, THE TOP OF THAT RETAINING WALL IS, UH, RIGHT HERE. AND THIS IS ACTUALLY ACROSS FROM THE BUILDINGS BELOW AND NOT ACROSS FROM THE ENTRANCE TO THE MUSE. AND THEN THE NEXT BUILDING AT, UH, WHICH ARE THE OR AVENUE TOWNHOUSES THAT ARE HIGHER. THAT, UH, RETAINING WALL NEXT TO THOSE TOWNHOUSES IS AROUND 17 FEET ABOVE THE GRADE AT THE ENTRY TO THE MUSE. AND THAT IS OVER HERE. UM, SO WHEN, WHEN SOMEONE'S UP IN BACK OF THOSE TOWNHOUSES, THEY'LL BE LOOKING JUST BELOW THE TOP OF THESE BUILDINGS HERE. UM, AND THEN WE JUST HAVE A FEW OTHER PHOTOGRAPHS. UH, THE NEXT PHOTOGRAPH IS TAKEN FROM THE FIRST FLOOR AT GRADE LOOKING UP AT THE RETAINING WALL. AND THE NEXT ONE IS ANOTHER VIEW OF THAT RETAINING WALL. UM, SO I HOPE THIS GIVES YOU AN IDEA OF THE RELATIONSHIP OF THE MUSE, THE ENTRY TO THE MUSE AND THE BUILDINGS, TO THE RETAINING WALL AND THE PROPERTIES, UH, JUST EAST OF, UM, THIS PROJECT. OKAY. ANOTHER ITEM WE ASKED TO, UH, STUDY IS, UH, WE LOOKED AT ALTERNATIVES TO, UM, HAVING INDIVIDUAL STAIRS TO THE BULKHEADS. UM, WE LOOKED AT HOW WE COULD DO THAT. WE WOULD HAVE TO COMBINE TWO UNITS AND TO SHARE A STAIR. AND THEN IT REALLY IS NOT POSSIBLE, UH, TO DO WITHOUT CARVING OUT REALLY IMPORTANT FLOOR AREA. WE ALREADY REDUCE THESE BY A THOUSAND SQUARE FEET, SO WE, WE REALLY CAN'T MAKE THAT OPTION WORK WHERE TWO UNITS COULD SHARE A STAIR OR THREE. SO WE LOOKED AT, UH, THE OTHER OPTION WAS TO PUT THE STAIR HERE WHERE THE BIKE RACK IS. UM, WE COULD HAVE A COMMON STAIR TO A ROOF DECK, [00:35:01] BUT THE DRAWBACK HERE IS THE UNITS WOULDN'T HAVE INDIVIDUAL ACCESS. AND THEN THEY WOULD, UH, THEY WOULD NEED TO COME OUTTA THEIR UNIT THROUGH THE MUSE INTO THE STAIR AND THEN UP TO THE ROOF. SO IT'S VERY INCONVENIENT. THE, THIS STAIR WOULD NOW BE LIKE A THREE STORY ELEMENT, WHICH WE'RE, WE THINK WOULD NOT BE, UM, VERY, UM, ATTRACTIVE. 'CAUSE WE HAVE SO MANY DIFFERENT HEIGHTS IN THIS, UM, COMPLEX, YOU KNOW, TWO AND THREE STORY BUILDINGS, AND ALSO IT'S RIGHT NEXT TO THE, UH, SEVEN WASHINGTON AND COULD BE A PROBLEM BECAUSE OF THE BULK OF THAT. AND THEN THE OTHER PROBLEM WITH THIS IDEA IS THAT WE, UH, WOULD ALSO LOSE THE BIKE STORAGE AND WE WOULDN'T KNOW WHERE TO PUT IT. SO WE, WE HAVE LOOKED AT OTHER ALTERNATIVES. UM, AND, YOU KNOW, THE BEST, THE BIGGEST BENEFIT THAT INDIVIDUAL BULKHEADS GIVE US IS THAT EACH UNIT HAS ITS OWN PRIVATE OUTDOOR SPACE. AND, UH, WHICH IS WHAT WE ORIGINALLY, UH, WAS A GOAL FOR THE PROJECT THAT, UM, EACH UNIT HAS THAT INSTEAD OF A SHARED ROOF DECK. UM, SO THAT ACTUALLY COVERS, I THINK, ALL THE AREAS THAT WE WERE EXPLORING. AND, UM, I GUESS I'D LIKE TO KNOW IF YOU HAVE ANY OTHER QUESTIONS. YEAH, WELL, WE'RE, UM, OKAY. THANK YOU FOR THAT. I THINK NEXT WHAT WE'RE GONNA DO IS HAVE I, I'D LIKE, UM, PATRICK, OUR VILLAGE PLANNER TO LET US KNOW IF YOU HAVE ANY ADDITIONAL COMMENTS. UM, WE ALSO HAVE A MEMO FROM OUR ENGINEERS. SO IF YOU'D LIKE TO, UM, TALK, TALK ABOUT THE OUTSTANDING COMMENTS ON THE ENGINEERING AND ANY OTHER COMMENTS YOU HAVE. NO, I, I DON'T HAVE ANY FURTHER SITE PLANNING ISSUES. AGAIN, THE, THE ISSUES THAT YOU ASKED TO BE STUDIED HAVE BEEN STUDIED. LET ME JUMP ON DOUG'S MENTAL YEAH. DETAILS. YEAH. SO DOUG STILL HAS A, A SIGNIFICANT NUMBER OF, OF SITE ENGINEERING ISSUES THAT NEED TO BE ADDRESSED. UM, UM, NOT ONLY THE ISSUES OF COMPLIANCE WITH RESPECT TO EASEMENTS AND, AND SO, AND, BUT STORMWATER MANAGEMENT RELATED ISSUES AS WELL. SO THERE'S WORK THAT DOUG NEEDS TO DO WITH THE REVIEW OF THIS THAT'S YET TO BE COMPLETE. HE HAD, UM, INFORMED US PREVIOUSLY, UM, THAT THOSE, HE DOESN'T THINK THAT THEY AFFECT THE PLAN SO MUCH. THE SITE PLAN, THE LAYOUT, UM, AND GIVEN, YOU KNOW, WE'RE STILL AT THIS POINT IN THE PROCESS WHERE THEY'RE GONNA HAVE TO GO TO THE ZONING BOARD, UM, BOTH FOR, UM, VIEW PRESERVATION WHEN YOU'RE READY TO SEND IT, AND ALSO FOR THE VARIANCES. AND YOU STILL HAVE TO COMPLETE SECRET, RIGHT? SO, UM, THE, THE ENGINEERING DETAILS ARE, ARE DETAILS THAT, UM, DOUG FELT ARE, ARE JUST DETAILS THAT CAN BE WORKED OUT. OKAY. ALL RIGHT. UM, WELL, WE CAN DO THIS TWO WAYS. WE CAN EITHER HAVE OUR CONVERSATION NOW OR I CAN TAKE PUBLIC COMMENTS. DO YOU GUYS HAVE A PREFERENCE? ALL RIGHT. I'M GONNA, I'M GONNA OPEN IT UP FOR, UM, THE PUBLIC. IF ANYBODY HAS ANY COMMENTS, PLEASE COME TO THE MICROPHONE. STATE YOUR NAME AND ADDRESS. UH, UH, UH, WELL, I'LL JUST LEAVE IT. UM, BRIAN ALLEN, 4 87 WARBURTON AVENUE. I ALSO, OH, SORRY. THANK YOU, SIR. UH, I ALSO REPRESENT, UH, AS ATTORNEY MIKE SHAW, WHO OWNS 4 83 4 85. SO SPEAK TO HIM AS WELL. UM, I JUST HAVE A FEW THINGS TO RESPOND TO. UH, THE, THE, THEY, THEY STILL CLAIM THE LIGHTING WILL BE ON FROM SIX 30 TO EIGHT 30, FROM SIX 30 IN THE MORNING TO EIGHT O'CLOCK DIRECTLY BEHIND MIKE'S BUILDING AND ALMOST DIRECTLY BEHIND MINE. THAT'S A LOT OF LIGHT AND IT'S VERY DARK. THE SUN GOES DOWN AT FOUR 10 TODAY THERE. I MEAN, WE'RE, THE CLOSER YOU GET TO THE RIVER, THE MORE THE SUN GOES DOWN BEHIND THE PALISADE. SO THOSE LIGHTS ARE GONNA BE ON AND THEY'RE GONNA BE A NUISANCE. UH, I'VE SAID THIS BEFORE, I'M JUST REITERATING, UM, THE ROOFTOP DECKS, UM, THE, THE ROOFTOP WRAP TOP DECKS, PICTURES THAT WE SAW ON THE NEW PRESENTATION ARE NOT ROOFTOP DECKS AT ALL. THEY'RE TERRACES, THEY'RE NOT ON THE ROOFS. THEY'RE ON THE FIRST TERRACE OF BOTH OF THOSE BUILDINGS. THEY'RE NOT UP ON THE ROOF. SO I DON'T KNOW WHAT RELEVANCE THOSE HAVE. THERE ARE NO ROOFTOP ROOFTOP DECKS IN THE SOUTH SIDE AT ALL. THIS, THIS WOULD BE THE FIRST TIME, WITH THE EXCEPTION OF SOME SMALL ONES IN THE, IN THE TOWN HOMES NEXT TO ME THAT ARE ALMOST ENTIRELY [00:40:01] SECLUDED OFF. UM, A LIMITATION OF FIVE FOOT TO OBJECTS ON THE ROOFTOP THERE. THAT ROOFTOP IS ALREADY AT THE RIVER LEVEL FOR ME. AND FOR THE FIRST FLOOR OF MIKE'S BUILDING, YOU WERE THERE ANY OBJECT? ONE FOOT BLOCKS A FOOT OF THE RIVER, FIVE FEET WILL BLOCK FIVE FEET OF THE RIVER. A HUMAN BEING WILL BLOCK SIX. UH, THE BULKHEADS BLOCK, ALL OF DEREK'S VIEW FROM NEXT DOOR. AND, UH, AND 40% OF MINE, SO I STILL DON'T UNDERSTAND WHY THIS IS COMPLIANT WITH VIEW PRESERVATION FURNITURE AND UMBRELLAS UP THERE WILL ALL BE BLOWN OFF AT SOME POINT OR ANOTHER. THERE ARE 40, 40, UH, MILE AN HOUR WIND GUSTS THERE. COMMONLY THEY COME OUTTA NOWHERE. MAYBE YOU'RE PAYING ATTENTION, MAYBE YOU'RE NOT. IS EVERYONE REALLY GONNA RUN UP AND GRAB THEIR UMBRELLAS? ABOUT 40 MILE AN HOUR WIND WILL DO AN UMBRELLA COMING UP MY BUILDING. AND I, I JUST DON'T SEE WHY THAT USE IS REALLY SAFE THERE. AND FINALLY, UM, THERE'S STILL NO RENDERING OR DESCRIPTION OF THE ROOFTOP RAILINGS AND PARAPETS THAT ARE GONNA BE NEEDED. AND THERE ARE ALSO FOUR FEET HIGH. AND THAT'S FOUR FEET OF MY, MY VIEW BLOCKING. WILL GLASS BE REQUIRED? WILL THERE BE POSTS? THEY BLOCK THE VIEW. SO I'M NOT SURE WE'VE GOTTEN TOO FAR WITH THIS. THAT'S ALL I'M SAYING. THANK YOU. THANK YOU. ANYBODY ELSE? I HAVE A QUESTION. JIM HAS THE PAN 15 RIDGE STREET. AGAIN, I DON'T UNDERSTAND HOW THIS, AND I DON'T KNOW IF THIS IS THE RIGHT FORUM, SO IF YOU, IF THIS TO FIRST, THIS IS FINE. UM, MY CONCERN IS PARKING. I DON'T UNDERSTAND HOW FOLKS ARE GONNA PARK INTO THIS TURNING IN. THERE'S SO MUCH CONGESTION ON WASHINGTON ALREADY. YOU'RE GONNA TAKE A PARKING SPOT OUT, OBVIOUSLY TO CREATE AN ENTRANCE, AND NOW YOU'RE GONNA ASK PEOPLE TO TAKE A 90 DEGREE TURN INTO THIS SPOT, RIGHT? WHEN THERE'S A LOT OF TRAFFIC ON WASHINGTON, THEY'RE PARKING ON BOTH SIDES. I JUST DUNNO HOW YEAH. THIS IS, IT'S BEEN, IT'S BEEN DISCUSSED AT LENGTH AND STUDIED AND, AND WE FEEL THAT IT'S ADEQUATELY ADDRESSED. SO, UM, YOU YEAH. , IS THERE A REPORT OF SOMETHING THAT THIS IS SAID THERE? BECAUSE I DON'T UNDERSTAND MINUTES FROM THE MEETINGS, THE RECORDINGS, ALL OF IT, YEAH. ALL RIGHT. SO I'LL GO THROUGH IT BECAUSE FROM THE BROADWAY THEATER CENTER AND WHERE THIS LOCATION IS, THERE'S A LOT, WE CAN'T EVEN ON RIDGE STREET CAN'T GET IN AND OUT OF OUR STREET YEAH. ALONG A PARKING, SO, UNDERSTOOD. NO, IT'S A, IT'S, UH, IT'S A VALID QUESTION. I JUST, WE IT IS OUR JOBS AS PLANNING BOARD MEMBERS TO REALLY STUDY THAT CAREFULLY AND ASK FOR A LOT OF INFORMATION. SO THIS HAS BEEN UNDER REVIEW FOR A WHILE. SO THEY SUBMITTED A TRAFFIC STUDY REPORT, I DON'T KNOW, EIGHT MONTHS AGO. YEAH, IT WOULD, IT'S IN THE PUBLIC RECORD FOR THESE, FOR THIS PROJECT FROM AND DIFFERENT HOURS OF THE DAY. I'LL LET GO LOOK THIS. JUST PUT YOUR NAME AND ADDRESS ON. SHE ALREADY DID. YEAH. THANK YOU. OKAY. ALL UM, ANYBODY ELSE? I THINK WE'RE, WE'RE GOOD. OKAY. UM, SO I WANT TO, UM, NOW HAVE OUR DISCUSSION AND JUST REMIND EVERYONE THAT WE'RE, UM, DISCUSSING VIEW PRESERVATION. AND OUR FOCUS HERE IS ON THE IMPACT OF THE NEW BUILDING ON THE VIEW OF THE PALISADES AND THE RIVER. AND WE HAVE TO CONSIDER WHETHER THE NEW STRUCTURES WILL CAUSE THE LEAST POSSIBLE OBSTRUCTION OF THE VIEW OF THE HUDSON RIVER AND THE PALISADES. SO, UM, WITH THAT, UH, I'D LIKE TO SEE IF ANYONE HAS FURTHER THOUGHTS SINCE THE LAST MEETING BASED ON THIS. I DO ACTUALLY, UH, I, UM, I WAS ALSO CONCERNED WITH THE SAME, ONE OF THE THINGS MR. ALLEN WAS SAYING, UH, WE ALSO ASKED ABOUT DETAILS FOR RAILINGS LAST TIME. YEAH. AND, UM, MAYBE I'M, MAYBE I'M FOCUSED ON THE WRONG THING, BUT ONE OF THE DRAWINGS YOU SHOWED, SO THE DETAIL FOR A PRIVACY FENCE THERE ON THE TOP LEFT CORNER IS, IS THAT FOR THE ROOF OR IS THAT FOR ELSEWHERE ON THE PROPERTY? THAT'S, THAT'S ELSEWHERE. ELSEWHERE ON THE PROPERTY. IT'S ELSEWHERE. WE HAVE DETAILS OF LING HAVE THE DETAILS. YEAH. LEMME TRY TO GET IT FOR YOU TO THE RIGHT. THE SECTION SHOW THE RELATIONSHIP. UM, IN THE, IN THE SECTIONS WE SUBMITTED, IT SHOWS THE RELATIONSHIP OF THE, THE LEVEL OF THE FLOOR DECK, THE HEIGHT OF THE PARAPET. UM, AND THEN, UH, YOU KNOW, THE, TO THE TOTAL HEIGHT FROM THE FLOOR, THE ROOF DECK TO THE TOP OF THE RAILING IS, UH, 42 INCHES. SO WE HAVE A, A LITTLE PIECE OF METAL RAILING, UH, AND A PARAPET SERVING AS OUR GUARD AT THE ROOF DECK. AND YOU CAN SEE THE FURNITURE IS REALLY MOSTLY COMPLETELY HIDDEN BY THE PARAPET. I THINK THE QUESTION IS WHAT'S THE MATERIAL? WHAT IS THE MATERIAL? YEAH, WHAT'S THE MATERIAL? OH, THE MATERIAL OF THE RAILING, RIGHT? THE THE RAILING. OH, THE RAILING. IT'S A, WELL, IT'S A, IT'S A STUCCO PARAPET. OH, STUCCO. IT'S A MASONRY PARAPET WITH A LITTLE PIECE OF, UH, STEEL RAILING ON TOP. YES. SO YOU'RE SORT OF, YOU'RE SITTING, THE, THE PARAPET IS REALLY THREE QUARTERS OF THE RAILING, THE GUARD. AND THEN WE HAVE A, JUST A LITTLE ADDITIONAL DECORATIVE RAILING TO ADD TO OUR HEIGHT. GOT IT. WHICH WE HAD SHOWN ON OUR ALLEGATIONS PREVIOUSLY. [00:45:04] OKAY. HAS THAT BEEN MOCKED UP IN THE PAST? I KNOW THAT THERE WERE MOCK UP IN THE TOP OF THE BUILDING PARA MOCK UP. WELL, THEY MOCK UP THE TOP OF WHERE THE, THE BULKHEADS BULKHEAD, THE PARA THAT'S CORRECT. PARA PITS WELL BELOW THE BULKHEAD. I SEE. YEAH. SO WE WERE LOOKING AT WHAT THE HIGHEST POINT WHERE IT WILL BE. YEAH, YEAH. UM, ANY OTHER QUESTION? GO AHEAD, RICHARD. NOT SO MUCH A QUESTION, UM, BUT MORE A COMMENT. UH, THE LONGER I'VE LOOKED AT THIS PROJECT, THE MORE TROUBLED I AM BY THE BULKHEAD AND THE ACTIVITY ON THE ROOF, UH, IN TERMS OF VIEW PRESERVATION AND PUBLIC SAFETY. UM, I KNOW THAT AREA REALLY WELL, AND I AGREE THAT THE, THE WIND FACTOR, UH, WOULD BE A DANGER. I THINK THE BULKHEAD AND THE ROOF ACTIVITY, UH, IS UNNECESSARY FOR THE SUCCESS OF THIS PROJECT. UM, I'M NOT TROUBLED BY THE DESIGN OF THE BUILDING. I APPRECIATE THE REDUCTION IN HEIGHT. I THINK THAT WOULD MAKE A GOOD PROJECT. UM, I'M TROUBLED BY THE BULKHEAD AND THE ROOF, YOU KNOW, UH, OR THE TERRACE ACTIVITY. YEAH. I'M, I'M NEW TO THIS, OBVIOUSLY. I KNOW THIS PROJECT HAS BEEN UNDER REVIEW FOR A LONG TIME. AND SO, YOU KNOW, I HESITATE BECAUSE I WASN'T ABLE TO OFFER THIS FEEDBACK EARLIER. AND I KNOW THAT THIS, UM, THIS PROJECT HAS BEEN REVISED MANY TIMES AND STUDIED MANY DIFFERENT WAYS. BUT, UM, JUST, YOU KNOW, AS, AS A NEWCOMER TO THE BOARD, I STRUGGLE TO UNDERSTAND WHY THE RECREATIONAL USE, UH, ON THE ROOF IS NECESSARY AND THEN STIPULATING THAT YOU'D LIKE A RECREATIONAL USE, WHY YOU COULDN'T HAVE SOME KIND OF A COMMON AREA WITH A SINGLE STARE AS WAS DESCRIBED EARLIER. SO, WELL, THANK YOU FOR THAT. AND IT, AND IT'S, UM, PERFECTLY LEGITIMATE FOR YOU TO OFFER YOUR FEEDBACK. AT THIS POINT. YOU'RE A NEW MEMBER BOARD MEMBER, AND WE'RE, THAT'S OUR JOB IS TO LOOK AT THINGS CAREFULLY SO YOU DON'T HAVE TO PRE PREFACE IT THAT WAY. APPRECIATE THAT. AND NOW THAT YOU'VE SEEN IT A COUPLE TIMES TOO, I THINK IT'S, IT'S GOOD TO, UM, SHARE YOUR OBSERVATIONS. YEAH. UM, ANYTHING ELSE? BOARD MEMBERS? JUST THAT I SHARE THOSE CONCERNS ABOUT ROOF USE. YOU KNOW, THERE, THERE COULD BE A RULE TO TAKE YOUR UMBRELLAS DOWN IN CERTAIN SITUATIONS, BUT WE KNOW IT'S NOT GONNA BE A HUNDRED PERCENT COMPLIANCE. SO IT'S, IT'S A POTENTIAL DANGER. IT'S SORT OF A, AN UNKNOWN IN TERMS OF WHETHER THERE WOULD BE A VIEW PRESERVATION ISSUE WITH ANY SORT OF MATERIALS ON THE ROOF. AND I, I AGREE IT DOESN'T SEEM NECESSARY FOR THE SUCCESS OF THE PROJECT, THAT RECREATIONAL USE ON THE ROOF. AND IT MIGHT ACTUALLY BE IMPRACTICAL TO TRY TO IMPOSE THAT RULE, BECAUSE OFTEN PEOPLE ARE AWAY AND YOU DON'T KNOW WHAT THE WEATHER'S GONNA BE. SO, I MEAN, RIGHT. YEAH. GO AHEAD TODD. YEAH. AS A, AS A SAILOR WHO'S BEEN OUT IN TAIL FORCE WINDS, I JUST, UH, AND, UH, ACTUALLY I'M FINE WITH USING THE ROOFS OF THOSE BUILDINGS, BUT PUTTING UMBRELLAS ON 'EM IS A BAD IDEA, I THINK. AND I, I, I'LL JUST COMMENT ON THAT, , I'VE SEEN THE EFFECT OF GALE FORCE WINDS ON CLOTH OBJECTS THE SIZE OF AN UMBRELLA, AND IT AIN'T GOOD. AND I, I MEAN, PRACTICALLY SPEAKING, MOST PEOPLE WILL FIND THE ROOF NOT USABLE WITHOUT AN UMBRELLA BECAUSE YOU'LL HAVE BLAZING SUN. SO I THINK PEOPLE WILL WANT TO HAVE UMBRELLAS. SO IT, IT'S SORT OF A CATCH 22. UM, IN TERMS OF SOME OF THE COMMENTS THAT I'VE HEARD ABOUT USING THAT SPACE IN THAT WAY WOULD BE INAPPROPRIATE TO REQUEST, UH, UH, ONE MORE REDESIGN, UH, ELIMINATING THE BULKHEAD AND THE ROOFTOP, UH, ACTIVITY. 'CAUSE I'M, I'M OKAY WITH, UH, THE MUSE. I'M OKAY WITH THE DESIGN OF THE BUILDING. UM, I, I, I THINK I'D LIKE TO SEE IT WITHOUT, YEAH. I, I, I MEAN, I THINK, YOU KNOW, OUR, OUR CONSIDERATION HERE IS IF WE'RE COMFORTABLE WITH WHAT'S BEING PROPOSED IN LIGHT OF VIEW PRESERVATION. AND SO WHAT I'M HEARING IS THERE IS A GREAT DEAL OF CONCERN ABOUT WHAT'S BEING PROPOSED ON THE ROOF FROM A VIEW PRESERVATION PERSPECTIVE AND A SAFETY PERSPEC PERSPECTIVE. AND THAT IS CERTAINLY SOMETHING WE NEED TO SERIOUSLY CONSIDER. SO I'M HEARING IT FROM PRETTY MUCH EVERY YOU TWO UNDERNEATH. WE DO. AND EVA, I THINK WHAT I'M HEARING TOO MAY RELATE TO SITE PLAN RELATED ISSUES TOO, IF THERE ARE MODIFICATIONS TO BE MADE. YEAH. IT'S NOT JUST VIEW PRESERVATION. YES. THE ROOFTOP, THE USE OF THE ROOF RIGHT. IS REALLY MORE A SITE PLAN ISSUE. YEAH. SO, UM, IF YOU'D LIKE TO COME UP AND SPEAK YOUR HEARING ARE COMMENTS, BUT IF YOU, YOU, YEAH, I JUST WANT, YOU KNOW, THERE'S BEEN APPROVAL FOR ROOF DECKS, 400 WARS. THOSE ARE ROOF DECKS THAT WE SHOWED YOU. UH, 5, 5 5, UH, WAR BURTON 5 68 WAR BURTON. [00:50:01] YOU KNOW, WE KNOW THAT WHEN A FAMILY LIVES IN THE DOWNTOWN, THERE ISN'T OUTDOOR SPACE. SO THE OUTDOOR SPACE VERY IMPORTANT TO, UH, THESE UNITS AND IT'S BEEN IMPROVED FOR OTHER PROJECTS. SO, UM, I KEEP THINKING IT'S REALLY THE WAY, THE FUTURE IF WE REALLY WANT, UH, GOOD HOUSING IN OUR DOWNTOWN. SO. OKAY. WELL, I, I DO WANNA SAY THAT WE, I MEAN, WE'RE LOOKING AT THIS PROJECT AND WE'RE CONSIDERING IT ON THE SITE THAT IT, WHERE IT'S LOCATED AND WITH A PARTICULAR, UM, DETAILS OF THIS PARTICULAR PROJECT. WE DON'T HAVE THE, UM, WE DON'T HAVE THOSE ADDRESSES RIGHT IN FRONT OF US TO COMPARE. BUT I, I THINK WHAT'S RELEVANT HERE IS LOOKING AT THIS PROJECT AND, AND CONSIDERING WHETHER WE THINK, UM, WITHIN THE TWO PRIMARY CONSIDERATIONS THAT ARE BEFORE US, WHICH ARE VIEW PRESERVATION AND SITE PLAN, UM, WHETHER WE'RE COMFORTABLE, UM, WITH WHAT'S BEING PROPOSED. AND, UH, THERE THE, EVEN THE EXAMPLES THAT ARE PROVIDED REALLY, UM, THEY'RE, THEY ARE TERRACES AND THEY'RE TUCKED UNDER, UM, THEY'RE FINE, YOU KNOW, NEXT TO, UM, A CONFIGURATION OF A BUILDING WHERE THE, THE WIND ISSUE IS NOT THE SAME AND THEY'RE NOT. UM, SO ANYWAY, THAT WASN'T WHAT, NEVERTHELESS, WE'RE LOOKING AT THIS. WE'VE CONSIDERED THAT, AND WE'RE ALSO LOOKING AT THIS. I THINK WE HAVE CONSENSUS ON THE BOARD, YOU KNOW, WE, WE DEAL WITH EACH SITE IN THE SPECIFICS OF THOSE SITES. YEAH. AND WE HAVE, AS A BOARD, WE'RE EXPRESSING A DISCOMFORT FOR THIS USE AT THIS LOCATION. YEAH. YEAH. IT'S NOT A PRECEDENT ISSUE FOR ME SO MUCH. IT'S, THERE'S, THE, THE DISCUSSED ROOF USAGE CREATES AN UNKNOWN THAT I THINK COULD POTENTIALLY SIGNIFICANTLY ALTER THE VIEW PRESERVATION ANALYSIS. YEAH. YEAH. GO AHEAD TOM. I JUST WANT TO, I THINK WE WERE, I WAS TALKING ABOUT SAFETY WITH REGARD TO THE UMBRELLAS, WITH REGARD TO VIEW PRESERVATION, I WOULD SAY WE HAVE MADE THIS APPLICANT JUMP THROUGH ENOUGH HOOPS TO, UH, I MEAN THE, THE BUILDING OF MOCKUPS THAT WE HAVE DONE, SITE VISITS, UM, I THINK WE HAVE PRETTY MUCH BEATEN THAT ISSUE TO MY SATISFACTION. I, I'M, YOU KNOW, AS SOMEONE WHO ATTENDED THE EARLY MEETINGS AND HAS BEEN FOLLOWING THIS THROUGHOUT AS IT'S BEEN COVERED, I, I AM SATISFIED MYSELF THAT, NOT THAT THERE IS NO VIEW IMPACT, BUT THAT THE APPLICANT HAS DONE EVERYTHING POSSIBLE TO MINIMIZE THE IMPACT. SO I'M SATISFIED I'S FINE. I'M JUST PUTTING, GOING ON RECORD MYSELF. THAT'S FINE. THAT'S GOOD. YOU SHOULD, YOU SHOULD EXPRESS WHERE YOU ARE WITH THE PROCESS. YEAH. I DO WANT POINT OUT SOMETHING, UM, VERY PLAINLY HERE, UM, BECAUSE WE'RE, WE'RE PART OF THE ARGUMENT FOR CREATING THIS OUTDOOR ACCESS IN THE WAY THAT IT'S BEING PRESENTED, UM, IS THE RESULT OF THE DEGREE TO WHICH THE SITE IS BEING DEVELOPED. UM, AND SO I JUST WANNA POINT THAT OUT, THAT THERE, THERE HASN'T, AND THROUGH ALL THE ITERATIONS, THIS PLAN HAS NEVER REDUCED THE NUMBER OF UNITS. UM, AND IT, IT'S, IT'S REMAINED, UM, YOU KNOW, PRETTY MUCH, UH, YOU KNOW, DEVELOPED TO THE, TO THE EXTENT THAT IT WAS FROM DAY ONE. I THINK THERE HAVE BEEN SOME TWEAKS TO THE DESIGN, BUT THAT, THAT IS ONE OF THE ISSUES THAT'S DRIVING, UM, SOME OF THE, THE CONSTRAINTS AND THE, AND THE, YOU KNOW, VARIANCES AND THINGS THAT WE'RE BEING ASKED TO CONSIDER. SO I JUST WANNA STATE THAT BECAUSE, UM, THE ALTERNATIVE IS REDUCING THE NUMBER OF UNITS OR CHANGING THE LAYOUT IN A WAY WHERE THERE'S OUTDOOR SPACE THAT ISN'T ON THE ROOF. THERE'S CERTAINLY SPACE FOR THAT. SO THESE ARE, YOU KNOW, I AGREE , IT'S A, A LIKE BALANCING ACT. YEAH. AND IT'S A SELF-IMPOSED, UM, CONSTRAINT AND HAVING TO PUT THE OUTDOOR SPACES ENTIRELY ON THE ROOFS BECAUSE OF THE WAY THIS SITE IS DESIGNED AND DEVELOPED. SO I THINK IT'S REALLY IMPORTANT TO PUT THAT ON THE TABLE. UM, AND I'LL JUST SAY THAT I WAS, WHERE YOU WERE AT TOM WHEN I FIRST CAME INTO THE MEETING, BUT LISTENING TO MY PLANNING BOARD COLLEAGUES, UM, I KIND OF HEARD THEM AND, UM, ESPECIALLY, YOU KNOW, THE SAFETY ISSUE WAS ALSO BOTHERING ME. SO IF IT CANNOT BE USED FOR RECREATIONAL USE FOR THAT REASON, THEN THE BULKHEADS DON'T HAVE TO BE THERE. SO THAT WAS DEFINITELY A SECONDARY CONSIDERATION FOR ME. 'CAUSE I ALSO DID FEEL LIKE WE HAVE [00:55:02] CONSIDERABLY CONSIDERED MANY OF THE ISSUES WE RAISED. SO THAT'S, THAT'S KIND OF WHERE I'M AT. SO WHAT'S THE NEXT STEP? WELL, UM, THAT IS A GOOD QUESTION BECAUSE I THINK, UM, THIS COULD HAVE GONE IN A LOT OF DIRECTIONS THIS EVENING. IT COULD HAVE BEEN, LET'S GO, YOU KNOW, REFER THIS TO THE ZONING BOARD OF APPEALS, YOU KNOW, RECOMMEND THE VIEW PRESERVATION. I THINK, UM, THE ISSUE HERE IS THAT WE DON'T, WE DON'T HAVE, UM, THAT RECOMMENDATION RIGHT. AMONGST SEVERAL BOARD MEMBERS. UM, SO I THINK, I THINK WE'RE GONNA HAVE TO ASK THEM TO CONSIDER WHAT WE'VE PRESENTED TONIGHT OR WHAT WE'VE, WE'VE SHARED. UM, YOU KNOW, I DON'T THINK WE TYPICALLY, WE DON'T REFER THINGS TO THE, UM, ZONING BOARD OF APPEALS UNTIL WE REALLY FEEL COMFORTABLE WITH WHAT WE'RE, YOU KNOW, WHEN WE MAKE THE REFERRAL, WE'RE BASICALLY SAYING WE ARE COMFORTABLE WITH WHAT'S BEING PROPOSED. UM, SO, UH, I THINK, LINDA, DO WE, DO WE TAKE UP CCRA AT THIS POINT? OR WHAT, WHAT IS YOUR RECOMMENDATION? NO, I, I DON'T THINK YOU'D DO THAT AT ALL. BECAUSE CCRA RELATES TO THE PLAN THAT YOU CHOOSE TO MOVE FORWARD. YEAH. YEAH. SO I THINK THE ANSWER TO RICHARD'S QUESTION IS THE BALL'S BACK IN THE APPLICANT'S COURT. YEAH. SO IF THE APPLICANT WANTS TO STICK TO THEIR GUNS, YOU COULD VOTE TONIGHT. I THINK THEY'VE SENSED WHERE THE VOTE WOULD GO. UM, IF I WERE THE APPLICANT, I WOULD BE CONSIDER OPTIONS, UM, AND DECIDE HOW TO ADVANCE THE, THE PROJECT. SO CLEARLY TO YOUR POINT, THERE ARE WAYS TO MODIFY THE PLAN TO MITIGATE THESE CONCERNS. IT MAY INVOLVE LOSING UNITS OR MODIFYING UNITS. THAT'S A SITE PLAN ISSUE. SO I THINK IT'S THE APPLICANT'S CHOICE ON HOW THEY WOULD CHOOSE TO PURSUE THIS. AND I DON'T THINK IT'S FAIR TO PUT THEM ON THE SPOT TONIGHT AND DEMAND AN ANSWER FROM THEM. RIGHT. I THINK THEY COULD, IF THE ANSWER IS WE'RE STICKING TO OUR GUNS YEAH. AND WE JUST TAKE A VOTE AND THEN WE SEE WHERE IT LANDS. BUT I THINK THE APPLICANT PROBABLY WOULD WANT TO CONSIDER THE ISSUES THAT THEY'VE HEARD TONIGHT AND, AND DECIDE IF THERE'S A METHOD TO DEAL WITH THEIR CONCERNS AND DEVELOP A ECONOMICALLY VIABLE PROJECT. I, I, I'M STILL, I'M STILL TORN ABOUT 'CAUSE I, I, I THINK I, I MEAN, I UNDERSTAND WHY A RECREATIONAL USE IS ATTRACTIVE. UM, I, A COUPLE OF THINGS. I MEAN, THERE WAS A PERIOD OF TIME WHERE YOU WERE PRESENTING SORT OF HYDRAULIC LIFT HATCHES, WHICH, WHICH WOULD'VE PROVIDED SOME ACCESS WITHOUT, WITHOUT ALL THE BULKHEADS. UM, AND I, YOU KNOW, THE, THE REASON FOR, UH, FOR WHY THOSE ARE NO LONGER AN OPTION OR WAS THIS ESSENTIALLY PRESENTED AS I CAN OKAY, GO AHEAD. SO FAR WE'VE HEARD WE DIDN'T LIKE 'EM. I DON'T SEE ONE ON AT A SHOWROOM UHHUH, AND THEN WE REPORTED BACK AND WE ALL DISCUSSED IT AND DON'T FEEL THEY'RE, THAT THEY DON'T SEEM SAFE. I MEAN, THEY HAVE THESE RAILINGS THAT POP UP, BUT STILL WE, UM, FELT THAT PROBABLY WASN'T THE BEST WAY TO HANDLE ACCESS TO THE ROOF. THAT'S WHY WE TOOK THAT OFF THE TABLE. OKAY. YEAH. SO, AND, AND JUST ON ON THE VIEW PRESERVATION ISSUE, AGAIN, YOUR ROLE IS, UM, TO GIVE A REPORT AND RECOMMENDATION TO THE ZONING BOARD. YOU'RE NOT THE ULTIMATE APPROVING, RIGHT? RIGHT. SO YOU COULD REFER IT WITH A REPORT AND RECOMMENDATION THAT THE BULKHEADS IN THE ROOF DECKS BE REMOVED. YOU COULD, AND THAT CERTAINLY WOULD NOT HELP THE APPLICANT WHEN THEY APPEAR BEFORE THE . NO. NO. BUT THAT IS AN OPTION. I THINK I I'M JUST SAYING IT IS AN OPTION BECAUSE IT, YOU, YOU'RE NOT THE ONE WHO ULTIMATELY APPROVES OR DENIES THE PRESERVATION APPROVAL. YOU MAKE A RECOMMENDATION. BUT IT IS A, IF IF THEY WANNA REVISE THE SITE PLAN TO TRY TO CREATE A USE, THEN I MEAN IT'S REALLY, AT THIS POINT, IT'S UP TO THEM. RIGHT. I MEAN, THEY GET TO DECIDE DO THEY WANT TO TRY FOR IT? YEAH. BECAUSE THEY'RE, WE DO NOT HAVE A MAJORITY. I THINK RIGHT NOW THEY'RE IN FAVOR WITH THE CURRENT PROPOSED PLAN. RIGHT. FOR THE REASONS THAT WE HAVE OUTLINED. YES. I COULD JUST FOR A COUPLE OF MINUTES, JUST ADD SOME THOUGHTS. I'M JACOB AMIR, AARON STEIN FOR THE APPLICANTS. I ACTUALLY WAS GONNA SUPPLEMENT WHAT WHAT PATCH HAS SAID, WHICH IS NO, WE DON'T WANNA BE PUT ON THE SPOT. WE HEARD ALL YOUR COMMENTS AND THEY'RE VERY GOOD COMMENTS. SO THE APPLICANT IS GOING TO GO BACK, LOOK AT THE ROOF ACCESS AND USE AND THE BULKHEADS. THE BULKHEADS ARE NECESSARY. UM, RECREATIONAL USE, MAYBE A DIFFERENT ISSUE COMPLETELY. AGAIN, I UNDERSTAND THE, THE ISSUE WITH THE UMBRELLAS AND TABLES AND THINGS UP THERE, THAT THAT IS A SAFETY ISSUE. SO WE'RE GONNA COME BACK, TAKE A LOOK AT IT AND COME BACK TO YOU NEXT MONTH. UM, I DO WANNA CORRECT ONE THING I THOUGHT I HEARD, MAYBE I MISHEARD. THE APPLICANT HAD SIGNIFICANTLY REVISED ITS PLANS. I THINK THERE WAS A THIRD FLOOR THAT'S, THAT'S NOW GONE. THAT'S A PRETTY MAJOR CHANGE. [01:00:01] YES. BUT IT, IT'S ALWAYS BEEN 2020. WHAT'S THE NUMBER? THE UNITS HAVE BEEN THE SAME. AGREED. AGREED. IT'S JUST, IT'S JUST THE THIRD FLOOR IS GONE. ALRIGHT. AND THAT, AND THAT WAS DONE IN THE SPIRIT AND THE HOPE OF, UM, OF THE VIEW OF PRESERVATION CONCERN. THAT WAS, THAT WAS PART OF THE REASON THAT THAT'S AN IMPORTANT CONCESSION, IF YOU WANT TO USE THAT, THAT WORD BY THE APPLICANT. SO WE WILL COME BACK NEXT MONTH. WHAT I WILL RESPECTFULLY ASK IS THAT NEXT MONTH, THIS BOARD HOPEFULLY IS IN THE POSITION AND WILL, UM, ISSUE A NEGATIVE DECLARATION UNDER CCRA AND MAKE THE REPORT AND RECOMMENDATION TO THE ZONING BOARD SO THAT WE CAN GO TO THE ZONING BOARD. WE'D LIKE TO, I THINK, I THINK WE'VE ALMOST EXHAUSTED IT TO THE POINT WHERE THE APPLICANT DOESN'T HAVE ANYTHING FURTHER TO PROVIDE UNLESS, UNLESS I HEAR SOMETHING ELSE. WELL, AGAIN, AGAIN, I THINK WHERE WE'LL BE NEXT MONTH IS OPEN TO HEARING WHAT YOU COME BACK WITH AND WE MAY BE IN THE SAME PLACE, IN WHICH CASE WE'RE HAPPY TO REFER IT IN THE MANNER THAT OUR, UM, VILLAGE ATTORNEY JUST SUGGESTED. SO WE'RE HAPPY TO DO THAT. BUT, YOU KNOW, THIS HAS BEEN AN ITERATIVE PROCESS. UM, WE HAVE, YOU KNOW, WE'VE SEEN SOME THINGS BE ADDRESSED AND WE HAVE SEEN OTHER THINGS NOT BE ADDRESSED. SO I THINK THAT'S WHERE WE ARE, I THINK, AND I THINK THE COMMENTS THAT HAHAN ENGINEERING HAD MADE, I THINK THOSE WERE RESPONDED TO, UM, TODAY. SO THOSE, THOSE DETAILS SHOULD BE RESPONDED TO. OBVIOUSLY THEY SHOULD BE DIGESTED. SO I UNDERSTAND WE NEED TIME FOR THAT AS WELL. UM, AND MY UNDERSTANDING WITH THE PROCESS OF THE REPORT AND RECOMMENDATION IS THIS BOARD CAN MAKE A, DOESN'T NEED TO MAKE A, UH, A WHOLE EITHER YES OR NO RECOMMENDATION. THE RECOMMENDATION CAN BE, I THINK, UNLESS I'M CORRECT, IT IS, WE, YOU KNOW, WE RECOMMEND POSITIVELY 80%. BUT WE HAVE A PROBLEM WITH, AS AN EXAMPLE, CERTAIN ELEMENTS OF THE, OF THE PROPOSAL. WELL, YEAH, WE, WE, WE, OUR PRACTICE IS THAT WE, WE PUT A LOT OF THOUGHT AND DELIBERATION INTO OUR RESPONSE TO THE APPLICANTS. AND WE, WHEN WE REFER MATTERS TO THE ZONING BOARD, WE GIVE THEM A SUMMARY OF OUR, UH, YOU KNOW, RESPONSES TO THE MATTERS AT HAND. AND SO THAT'S HOW WE'RE GONNA DO IT. SO WE'LL SEE WHERE WE ARE NEXT MONTH. GREAT. UM, BUT YEAH, ON NEXT MONTH, MADAM CHAIR AND FOR THE APPLICANT, UM, I WON'T BE HERE. YOU'RE NOT GONNA BE HERE, SO WE'LL BE DOWN. YES, THAT IS A VERY GOOD POINT. SO THAT IS A VERY GOOD POINT. IT'S A, IT'S A HOLIDAY MONTH AND I KNOW WE HAVE AT LEAST TWO ABSENCES. UM, SO YOU TAKE YOUR RISK WITH THE REDUCED BOARD, THERE'LL BE A QUORUM, BUT THE VOTE WILL BE CLOSER. CLOSER. YEP. QUICK, QUICK CLARIFICATION. SOMETHING YOU SAID, YOU SAID THERE'S GONNA BE BULK HEADS WHETHER THERE'S A RECREATION RELEASE OR NOT. IS THAT WHAT YOU SAID? I THINK SO, BUT I GUESS I CAN BE CORRECTED IF THAT'S WRONG. OKAY. YOU NEED ACCESS TO THE ROOFTOP, BUT I, THIS, THERE ARE MANY WAYS TO PROVIDE ACCESS WITHOUT A BULKHEAD. COULD SOMEONE SPEAK TO THAT? 'CAUSE I THINK THAT'S BEFORE NEXT MONTH OR THE NEXT HEARING. THAT'S A PRETTY CRITICAL POINT, BUT YEAH, I, I, I HEARD THAT THAT'S, THAT'S BEEN ADDRESSED OR DISCUSSED BEFORE. BUT I CAN, I CAN DEFINE IT TO NO, OUR, OUR UNDERSTANDING IS THE, THE NATURE OF THE BULKHEAD IS FOR THE EASE OF USE FOR IT AS A RECREATIONAL SPACE. IF IT'S JUST TO ACCESS THE ROOF, IT DOESN'T, THERE ARE OTHER, THERE ARE OTHER, OKAY. THERE ARE OTHER OPTIONS. ONE, ONE THING TO, TO BE PART OF WHAT WE'RE GONNA LOOK AT AND COME BACK TO YOU NEXT MONTH AND HOPEFULLY HAVE SOMETHING COMPLETE. OKAY, GREAT. THANK YOU FOR THAT. THANK YOU. APPRECIATE IT. THANK YOU. OKAY. ALRIGHT. UM, I SHOULD SAY, UH, THINGS HAVE BEEN A LITTLE OUT OF ORDER THIS EVENING, SO I DO WANNA ACKNOWLEDGE, UM, THERE WAS AN AGENDA ITEM ON OUR AGENDA EARLIER, UM, WHICH WAS THE, UM, THE APPLICATION FOR A TWO LOT SUBDIVISION AT WARREN AND PEARL STREET, WHICH HAS BEEN ADJOURNED. YES, YES. IT'S BEEN ADJOURNED. THE APPLICANT'S REQUEST AT THE APPLICANT'S REQUEST. SO IF YOU'RE HERE FOR THAT, UM, I DIDN'T SEE THE A DU AT SEVEN HORNER. THEY WITHDREW. YEAH, BUT I DIDN'T SEE IT. OH, THAT CAME IN THE OTHER DAY. AN AMENDED AGENDA WAS SENT OUT. OKAY. IT'S ALREADY BEEN ADDRESSED. OKAY. SO WE ALSO, WE NO LONGER HAVE THE A DU AT SEVEN HORNER AVENUE, BUT THAT WAS ALREADY TAKEN OFF WITH THE LATEST MAILING.
